California restricted single-use plastics in August of this year, after passing Senate Bill 62 in 2021, guaranteeing a minimum wage for garment workers and holding brands accountable to violations. And, New York senator Kirsten Gillibrand brought the landmark Fashioning Accountability and Building Real Institutional Change (Fabric) Act to the US senate in May, hoping to pass similar labour protections at the federal level. The shift from corporate self-regulation to wide-reaching legislation isn’t unique to the US. The European Union has outlined proposals to achieve sustainable and circular textiles by 2030, curb hazardous chemicals, encourage extended producer responsibility (EPR) and unlock circularity through digital product passports, among others.Under the original Fashion Act, fashion companies selling products in New York and generating more than $100 million in revenues would have to map at least half of their supply chains and disclose impacts such as greenhouse gas emissions, water footprint and chemical use. Advocates for degrowth and transparency were particularly encouraged by the requirement for brands to report on total material production. According to the 2022 Fashion Revolution Transparency Index, only 15 per cent of brands currently do this, and those who don’t are able to make claims about reducing material impact while increasing actual volumes and their overall footprint.
